You have 10 days to review any introductory selection(s) you have made and the terms of membership contained in this Membership Agreement between you and CHCanada.com. If you are not satisfied for any reason, you may simply return any introductory selection(s) at our expense along with a note telling us you want to cancel your membership and you will have no further obligation. Your $5.99 (Canadian) one-time membership fee will be refunded promptly. Each DVD you buy priced $4.99 or higher counts as one unit toward fulfilling the purchase commitment described above. As a member of CHCanada.com, you'll be able to choose from a huge selection of Hollywood's best movies and, because we are adding new titles all the time, you'll be sure to find lots of great DVDs to add to your collection. DVDs on CHCanada.com are available from prices as low as $4.99. We reserve the right to limit the number of selections we will send. Multiple quantities of particular selections may also be limited. If your account becomes overdue, or if you do not fulfill your purchase commitment within each 12-month period you remain a member of CHCanada.com, or if you cancel your membership before fulfilling your purchase commitment for the 12-month period in which you cancelled your membership, we will send you a reminder. If, thereafter, you do not fulfill your Membership Agreement, the credit card you have chosen to keep on file will be charged $4.99 for each remaining purchase commitment selection(s) (i.e., up to two missed DVD purchase commitments per year at $4.99 each), plus shipping and any applicable sales tax. Certificates will be sent to you which can be applied towards the selection(s) that fulfills your membership commitment. If you incur such charges, and do not subsequently apply the Certificates you will receive towards the selection(s) that fulfills your membership commitment, within 3 months of receiving the Certificates, your account will be cancelled and no further charges will be incurred. You may cancel your membership at any time by contacting us at the above-noted address. There are no cancellation fees or charges associated with cancelling your membership. However, and as noted above, if you cancel your membership before fulfilling your purchase commitment(s) for the 12-month period in which you cancel membership, $4.99 plus shipping and applicable sales tax will be payable per missed purchase commitment. Selections you receive from CHCanada.com are for your personal use only and not for resale or other commercial use. top Periodic Emails As a member of CHCanada.com, you agree to receive periodic emails highlighting new releases and special sales. These emails are part of being a member of CHCanada.com, and you may not opt-out of receiving them. If you cancel your membership, you will no longer receive periodic emails. Without your consent, we will not sell, share, license, trade or rent your personal information to others. We may disclose personal information to third parties engaged to assist us in providing services contemplated by this Membership Agreement. For full details of the privacy policy of CHCanada.com top Billing and Payments We accept the following credit cards at this time: American Express, VISA and MasterCard. Replacement of, and credits to your account for shipped merchandise claimed as not received are subject to our investigation, which may include postal-service notification. We will adjust your account at our discretion. Repeated claims of undelivered merchandise may result in the cancellation of your membership and billing you for any remaining purchase commitments you may have. We will charge your credit card when we ship your order. Pre-orders will be charged to your card at the time your order is submitted. If you do not fulfill your purchase commitment within each 12-month period you remain a member of CHCanada.com we will send you a reminder. If, thereafter, you do not fulfill your purchase commitment, the credit card you have chosen to keep on file will be charged $4.99 plus shipping for each remaining purchase commitment selection(s) (i.e., up to two missed DVD purchase commitments per year at $4.99 each), plus shipping and any applicable sales tax, on your membership anniversary date. You will receive certificates which you will be able to apply towards the selection(s) that fulfills your purchase commitment. You will receive certificates which you will be able to apply towards the selection(s) that fulfills your purchase commitment. top Shipping and Processing Charges Because we deliver right to your door, a shipping & handling charge is added to all shipments. Shipping & handling for DVDs and CDs is $1.99 per disc for orders up to 2 discs. Orders of 3 or more discs get a flat rate of $5.99 total. For merchandise items, a shipping & handing charge and any applicable sales tax will be added to each item. This charge varies based on size and weight of the item ordered. Please be sure that we have your correct street address when ordering. Items cannot be delivered to a post office box. Unopened merchandise items can be returned for a full credit minus shipping & handling charges within 30 days of purchase. Orders are usually processed the same day or the next business day. For Ontario and Quebec delivery, please allow 5–10 business days. For the rest of Canada, please allow 7–14 business days. Please Note: Due to the large volume of orders during certain promotions, please allow an extra 2 to 5 days (in addition to the timeframe listed above) for your order to arrive during times that are traditionally heavy for Canada Post. You do not necessarily need to be home to receive your order. However, we may require a delivery signature on orders of $150 or more to help make sure your order is not lost or stolen. Please note that you can choose to have your order shipped to an alternate address if you are concerned about missing the delivery. Deliveries are made Monday through Friday, holidays are excluded. All orders are shipped via Canada Post Regular or Expedited Mail. Delivery location (mailbox, front porch, outside garage, etc.) is determined solely by the mail carrier. If your expedited order was placed before 9:00 a.m. ET (excluding holidays), it will be processed and shipped the same day. If placed after 9:00 a.m. ET (excluding holidays), it will be processed and shipped the following business day. top Returns When and how you may return product varies according to the order, and whether you have opened the mailing carton or the enclosed selection. Here is how our policy works: All Returns: Must be made within 30 days of the shipment-invoice date. We reserve the right to refuse all other returns. Refused returns will result in no refunds or adjustments whatsoever and the product will not be returned to you. Your account will be credited the purchase price for returns made within 30 days of the shipment-invoice date. NOTE: Membership may be cancelled and/or certain shipments may be withheld for what we determine to be an excessive number of returns. Unopened Selections (the outer wrap and other seals on the selection are intact): On selections that you have ordered, unopened selections can only be returned for a credit of the invoiced amount less the original shipping and processing charges. In other words, you must return them at your expense and we will not refund any of the shipping and processing charges incurred from the original or prior shipment. If you mistakenly receive a selection that you did not order, the unopened selection(s) may be returned at our expense for full credit. Include a note with your account number explaining the reason for return and if you're seeking a replacement or account adjustment. If you haven't opened the mailing carton at all, simply write "Refused - Return to Sender" on the carton and drop it in the mail. Opened Selections (The outer wrap or other seals have been removed from the selection.): If you have opened or removed the outer wrap or other seals from the enclosed selection, NO REFUNDS, ADJUSTMENTS, OR CREDITS WILL BE MADE, unless the selection is defective or arrived damaged. For defective selections or selections that arrive damaged: Include a note with your account number explaining the reason for return and if you're seeking a replacement or account adjustment. We may also be contacted at (866) 945-6470. top Local Taxes You will be charged applicable sales taxes. top Membership Cancellations We will do everything to make your membership as satisfying as possible. However, you are free to cancel your membership anytime after you've fulfilled your purchase commitment(s) for the 12-month period in which you cancel your membership, as described above, by writing to us at: Customer Service Department, CHCanada.com, 5900 Finch Avenue East, Scarborough, Ontario, M1B 5X7 or by contacting us at (866) 945-6470. There are no other fees associated with cancelling your membership. We must limit memberships to one per person. We may terminate your membership, without notice, for conduct we believe violates this Agreement or our policies, is harmful to other Members or our business interests, or for an inactive account. If you do not fulfill your purchase commitment in a yearly period (i.e., if you do not purchase at least two (2) DVDs priced $4.99 or higher within a yearly period), and subsequently, following the receipt of a reminder, incur charges of $4.99 plus shipping and applicable sales tax per missed purchase commitment, and do not apply the Certificates you will receive towards the selection(s) that fulfills your membership commitment within 3 months of receiving the Certificates, your account will be cancelled and no further charges will be incurred. top Additional Terms By continuing your membership, you accept and agree to the terms of this Membership Agreement and any changes made by us to it once we notify you of these changes. If you do not wish to be bound by this Agreement, please see above for how to return any introductory selections and cancel your membership within 10 days of joining. After that, or if you do not accept any change, you must complete any remaining purchase commitments, as described above, and then cancel your membership. Your edits or changes to this Agreement or a membership offer will not be effective, regardless of form. You must provide and keep us up to date with accurate member information, including your name, address, email address, or credit card number and expiration dates. You agree that we may update your information with information your bank or credit card issuer may supply. We are not responsible for any fees or charges that your bank, credit card or debit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method through a mailed statement. top If any term or other provision of this Membership Agreement is invalid, illegal or incapable of being enforced by any rule of law or public policy, all other conditions and provisions of this Membership Agreement shall nevertheless remain in full force and effect so long as the economic or legal substance of the transactions contemplated hereby is not affected in any manner materially adverse to CHCanada.com. |
